The Failure of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency caused by the introduction of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been defused. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of opposing developments captured the grim essence of the current period. By day, negotiation efforts are fought: positive announcements are released from multiple capitals. Immense energy is expended on containing specific proposals. By night, Russian leadership clearly shows the world that, for them, war remains the key method for achieving "resolution".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting rocket firings from Russian territory, a capacity enabled by timely intelligence. From vantage locations, Ukrainian air force fighter jets that had been deployed to counter approaching aerial threats roared overhead – modern combat jets provided to Ukraine by NATO members.

Moments later, Kyiv's missile defense thundered: defensive missiles fired to intercept a Russian ballistic missile. This was a modern interception technology at work, presumably provided by partner states. Every firing shakes the surroundings, causing tremors. The moment of terror quickly gives way to sober acceptance: maybe the approaching threat won't strike its target this time, sparing the city from ruin and further power outages.

Continuous Dangers

Not long after, a large-caliber weapon fired at a drone in the vicinity, part of a defensive team – almost certainly imported technology. Unfortunately, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

Intermittently, this carried on until dawn. Kyiv greeted the daybreak reports: multiple fatalities, devastation and heating outages in numerous residences as a result of the evening attack. As typically, everyone still went about their day – living the war. But those entire period demonstrated Ukraine's critical military reliance on Western support – a dependence that regional partners are evidently unprepared to replace in the immediate future.

Failed Diplomacy

The detailed framework from US administration provoked deep reactions, debate and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and bilateral conferences.

Every new initiative from US leadership follows the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, manages to fend off. They manage the tension but never actually win the battle. This cycle will, no doubt, persist.

Strategic Calculations

It is tempting to accuse particular leaders of consistently pushing Kremlin's demands. But that does not seem to be the whole story. American leadership operates on a assumption familiar among international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The US administration assumes that it is impossible to compel Moscow to surrender the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, Washington does little to prevent Kremlin actions, through diplomacy or military means, from assuming that the current condition will not change more in its advantage in the coming year.

Opposing Positions

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their motivation to agree to terms that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to end hostilities, but they will carry on as long as Russia's leader remains highly assured in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing civilians and areas but avoiding a total frontline collapse until situations evolve in its benefit.

Current Realities

Objectively, there are no actual prerequisites for a truce. Now, personal considerations are coming into play: personal goals to negotiate peace and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any proposal Kyiv finds unworkable, so that their focus does not switch to homefront challenges. And although their objective will now be significantly challenging after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are driving the talks.

Assessment and Future

It took a just a single week to kill the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by Washington, opposition by Ukraine and the other European countries, along with calming attempts of diplomats, and finally, current information leaks, all did their job.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and show particular unwillingness to alter the situation, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, primarily depend on ongoing international assistance.
